India’s trademark registration process is managed by five primary offices situated in major cities: Mumbai, Delhi, Kolkata, Chennai, and Ahmedabad. A trademark registration is initially valid for a period of ten years. However, it is important to note that this registration is renewable indefinitely. Renewing a trademark is crucial for maintaining your brand’s protection and rights. A registered trademark offers several advantages:

A trademark is valid for ten years, and it’s essential to renew it to keep your rights intact. The registrar will send a reminder six months before the expiration date. You have two options for renewal:

  • Renew as is
  • Renew with modifications

You can file the renewal application using Form TM-R. The application can be submitted by the trademark owner, an authorized representative, or an agent.

  1. Submit Form TM-R
  2. Monitor Application Status: Watch for any oppositions from the public.
  3. Publication: Once approved, the trademark will be published in the Trademark Journal.

Renewal Fees:

  • Physical Filing: ₹10,000
  • Online Filing: ₹9,000

Required Documents:

  • Registration certificate
  • Form TM-A (original application)
  • ID and address proof of the applicant
  • Power of attorney (if applicable)

If you miss the renewal deadline, you can still restore your trademark. Under Section 25 (4) of the Trademark Act, 1999, you can apply for restoration, which allows you to renew the trademark after the expiration with a penalty.

  • For Accounts Subject to Audit: The deadline is October 31st of the assessment year.
  • When Reporting with Form No. 3CEB: The due date is November 30th of the assessment year.
