Trademarks play a pivotal role in establishing and differentiating your brand in the marketplace. They encompass various elements such as logos, designs, and specific words or phrases that uniquely identify your products or services. This distinctiveness not only helps consumers easily recognize and remember your brand but also differentiates it from competitors.

In India, trademarks are not just a symbol but are legally recognized as intellectual property. This recognition provides robust protection against unauthorized use and infringement. Under the Trademark Act, 1999, trademarks are safeguarded by law, ensuring that your brand’s unique identity is protected from potential threats. By registering your trademark, you secure exclusive rights to use it, giving you a legal shield against any attempts to mimic or copy your distinctive brand elements.

The registration process, outlined in Section 18 of the Act, typically takes 1-2 years. Here’s a brief overview:

  1. Vienna Codification – The mark is classified.
  2. Formalities Check – Ensures all necessary documents are provided.
  3. Examination – An examiner reviews the mark for any legal issues.
  4. Publication – The mark is published in the Trademark Journal for public review.
  5. Objection Period – A 3-month window (extendable by 1 month) for third parties to raise objections.

If no objections are raised, your trademark will be registered, granting protection for 10 years, with the possibility of renewal.

Objections can be raised by an examiner or a third party. Common reasons include:

  • Incomplete Information: Missing or incorrect details in the application.
  • Similar Existing Trademarks: Conflicts with already registered trademarks.

Third parties can object when the mark is published or if the mark is used before registration. Upon objection, the application status changes to “Opposed.”

To address an objection:

  1. File a Counter Statement: This must be done within 2 months of receiving the objection notice.
  2. Hearing: If needed, a hearing will be scheduled. The Registrar will decide based on the hearing outcome.

If the objection is upheld, you may appeal to the Intellectual Property Appellate Board (IPAB) within 3 months. If delayed, you must file a petition with a fine of Rs 2,500 explaining the reason for the delay.

The IPAB will review the case based on submissions from both parties. If a party fails to appear, the IPAB may:

  • Rule on the case
  • Issue an ex parte order
  • Dismiss the case

If dissatisfied with the IPAB’s decision, you can appeal to the High Court, and further appeals can be made to the Supreme Court of India.

  • For Accounts Subject to Audit: The deadline is October 31st of the assessment year.
  • When Reporting with Form No. 3CEB: The due date is November 30th of the assessment year.
  • For Non-Audited Accounts: The deadline is July 31st of the assessment year.

When filing the ITR-6 form, you do not need to attach any documents, such as TDS certificates. However, it is important to reconcile the taxes deducted, collected, or paid on your behalf by comparing them with your Tax Credit Statement Form 26AS.
