Steps for Registering a Trademark
Trademark registration is managed by the Registrar of Trademarks and involves several steps:
a. Choosing a Trademark: Select a unique mark that distinguishes your business. There are 45 classes under which goods and services can be registered—classes 1-34 for goods and 35-45 for services.
b. Trademark Search: Before applying, it’s essential to check if a similar mark is already registered. This can be done through the Controller General of Patents, Designs, and Trademarks’ website or with the assistance of legal services.
c. Filing the Application: Fill out Form TM-A to register your trademark. Costs for filing vary depending on the type of business, with reduced fees for startups and small enterprises.
d. Submitting Documents: The required documents include identity proof, address proof, and the digital version of the trademark.
e. Confirmation and Examination: After filing, your application is examined to ensure compliance with trademark laws.
f. Trademark Journal Publication: If approved, your trademark is published in the Indian Trademark Journal. If no opposition is raised within 4 months, the registration proceeds.
Trademark Opposition and Final Registration
If someone opposes your trademark, a legal process begins. You will need to respond with a counter-statement, and both parties will present their cases. If no objections arise, or if the opposition is overruled, the trademark will be officially registered, and a Trademark Registration Certificate will be issued.
