Consent from all existing Partners is typically necessary to add a new Partner to an existing LLP. However, if the LLP agreement allows, one Partner may have the authority to admit new Partners without the consent of all existing Partners. If a new Partner wishes to join the LLP, they must notify their intention to join in Form 6. Once admitted as a new Partner, the LLP must file Form 4 within 30 days of the date the individual becomes a Partner. Form 4 must be signed by an existing Designated Partner. Additionally, a practicing Company Secretary or Chartered Accountant must provide a certificate confirming that they have verified all the details of the Partner's addition, including the books and records of the LLP, and found them to be accurate.
Furthermore, in order to add a Partner, an addendum to the existing LLP Agreement must be executed.
